Affiliate Program Terms

These Affiliate Program Terms (the “Terms”) govern participation in the 99k Africa Affiliate Program (the “Program”). The Program is operated by Care Med LLC, trading as 99k Africa (“99k Africa,” “we,” “us,” or “our”), located at 2636 Cantura Dr, Mesquite, Texas 75181-4661, United States.
By applying to or participating in the Program, you (“Affiliate,” “you,” or “your”) confirm that you have read, understood, and agreed to these Terms, together with the 99k Africa Terms and Conditions and Privacy Policy.
If these Terms conflict with the general Terms and Conditions on a matter specific to the Program, these Affiliate Program Terms control for that matter.
1. Eligibility and application
Submitting an application does not guarantee acceptance. We may approve or reject an application based on compliance, fraud, reputational, operational, or other legitimate considerations.
You must keep your account, contact, payment, and promotional information accurate and up to date.
- You must be at least 18 years old and legally capable of entering into a binding agreement.
- You must maintain an active 99k Africa buyer or vendor account.
- Your account must not be banned, suspended, or deactivated.
- You must submit complete and accurate application information, including your proposed promotion methods, audience, markets, website, and social-media channels where applicable.
- You must accept the current version of these Terms.
2. Affiliate relationship
If your application is approved, we grant you a limited, non-exclusive, non-transferable, and revocable right to promote eligible products using affiliate links provided by 99k Africa.
Participation does not create an employment, partnership, agency, franchise, joint-venture, or representative relationship. You may not make commitments, warranties, or representations on behalf of 99k Africa or any seller.
You are responsible for your own promotional activities, expenses, equipment, taxes, and regulatory obligations.
3. Affiliate links and attribution
You must use the product-specific affiliate links generated by 99k Africa. Editing, disguising, manipulating, or interfering with the tracking information contained in an affiliate link is prohibited.
Attribution may depend on cookies, device information, login status, and other technical tracking methods. Attribution may be unavailable where, for example, a customer blocks or deletes tracking information, changes devices or accounts, uses an expired link, or completes the purchase through an unsupported route.
Our records will determine attribution in the absence of an evident technical or calculation error.
- The attribution window is 30 days from the last valid affiliate-link click, unless a different period is displayed in your affiliate account.
- Attribution is product-specific.
- If a customer clicks more than one valid affiliate link for the same product, the most recent eligible click will normally receive attribution.
- The customer must place the order within the attribution window and satisfy all eligibility requirements.
4. Eligible transactions
Commission may be earned only on a genuine transaction that is properly attributed through a valid affiliate link, successfully paid and verified, associated with an eligible product and seller, completed, and clear of the applicable commission-hold period.
You must not reimburse, reward, or otherwise arrange for another person to place an artificial order for the purpose of generating commission.
- Your own purchases, self-referrals, and purchases from your own vendor store are ineligible unless expressly permitted in writing.
- Artificial, duplicate, test, manipulated, or fraudulently generated transactions are ineligible.
- Cancelled, failed, unpaid, returned, refunded, or charged-back orders are ineligible.
- Transactions generated through prohibited advertising or promotional methods are ineligible.
- Orders involving prohibited products or other violations of 99k Africa policies are ineligible.
5. Commission calculation
The applicable commission rate is the rate recorded by 99k Africa for the eligible transaction. The current standard rate may be displayed as 5%, but rates can differ or be changed prospectively.
Unless stated otherwise, commission is calculated on the eligible product-sale amount after applicable product or order discounts. It is not calculated on delivery or shipping charges, taxes, duties, government charges, payment-processing or service fees, refunded or cancelled amounts, or other excluded charges shown during checkout.
The commission rate recorded when an eligible order is created will normally continue to apply to that order even if the Program rate changes later. Amounts may be rounded to the smallest unit of the transaction currency.
6. Pending and available commission
Commission initially appears as pending. Pending commission is not yet payable and may be reviewed, adjusted, or reversed.
Commission becomes available only after payment has been confirmed, the order has been completed, the applicable refund, dispute, and commission-hold period has passed, and the transaction has passed relevant compliance and fraud checks.
Figures displayed in your dashboard are informational and may change to reflect refunds, payment disputes, corrections, or investigation results.
7. Refunds, reversals, and negative balances
If an order is cancelled, refunded, partially refunded, returned, charged back, or determined to be ineligible, the related commission may be reversed in full or proportionally. A reversal may be applied after commission has become available or has already been withdrawn.
If a reversal causes a negative balance, we may offset the amount against future commissions, deduct it from a pending withdrawal where permitted, request repayment, or restrict withdrawals until the balance is resolved.
Fraudulent or erroneous commissions may be corrected whenever discovered, subject to applicable law.
8. Withdrawals and payments
The minimum withdrawal amount is the amount displayed in the Program at the time of the request. The current default minimum is ₦5,000.
You must provide complete and accurate payout details. You may be required to provide identity, bank-account, tax, or other verification information before receiving payment. Payout details must belong to you or to an entity you are legally authorized to represent.
Withdrawal requests may be reviewed for compliance, fraud prevention, or payment verification. Processing times are estimates and may be affected by banks, payment providers, public holidays, or incomplete information. Applicable transaction charges, taxes, or legally required deductions may be deducted where properly disclosed or required by law.
If a transfer fails, the relevant amount will normally be returned to your available balance after the failure is confirmed. Where a payment provider reports an uncertain or pending result, the amount may remain reserved until the payment status is resolved.
9. Promotional disclosures
You must clearly and prominently disclose your affiliate relationship whenever you promote an affiliate link. The disclosure must be understandable and placed close to the link or recommendation.
Suitable wording includes “Affiliate link — I may earn a commission if you purchase through this link,” “Paid affiliate promotion,” or a clearly understood #Ad or #Affiliate label.
The disclosure must not be hidden among hashtags, placed only on a profile page, or presented in a manner an ordinary customer is unlikely to notice. You must also disclose free products, discounts, sponsorships, or other benefits connected to a promotion.
10. Prohibited promotional practices
Promotions must comply with applicable advertising, consumer-protection, data-protection, and platform rules. Where regulatory or pre-publication approval is required, you must not publish the relevant advertisement until the necessary approval has been obtained.
- Do not make false, misleading, exaggerated, or unsubstantiated claims.
- Do not misrepresent product prices, availability, quality, benefits, guarantees, or expected results.
- Do not present yourself as an employee or authorized representative of 99k Africa.
- Do not use fake reviews, fabricated testimonials, or undisclosed endorsements.
- Do not send spam or unsolicited bulk email, text, or social-media messages.
- Do not use bots, click farms, forced clicks, cookie stuffing, adware, misleading redirects, pop-ups, or hidden affiliate-link placements.
- Do not bid on 99k Africa trademarks in paid search advertising without written permission.
- Do not register domains, social-media usernames, or business names that impersonate or could reasonably be confused with 99k Africa.
- Do not promote links through unlawful, discriminatory, hateful, sexually exploitative, violent, or deceptive content.
- Do not infringe another person’s copyright, trademark, publicity, privacy, or other rights.
- Do not offer incentives for clicks or purchases unless approved by us in writing.
- Do not promote prohibited, counterfeit, or unlawfully supplied products or collect or misuse customer information.
11. Brand and intellectual property
We may provide approved logos, product images, links, and promotional materials. You receive a limited license to use those materials solely for your participation in the Program.
You may not materially alter them, claim ownership, sublicense them, or use them after your participation ends. All rights in the 99k Africa name, branding, platform, and materials remain with Care Med LLC, 99k Africa, or their respective owners.
You must remove or correct promotional content promptly if we notify you that it is inaccurate, outdated, unlawful, or inconsistent with our brand requirements.
12. Monitoring and investigations
We may monitor affiliate links, traffic, orders, promotional content, and payout activity for security, compliance, quality, and fraud-prevention purposes. We may ask you to provide information or evidence about your traffic sources, advertisements, audience, promotional methods, or transactions.
During an investigation, we may disable affiliate links, place commissions or withdrawals on hold, restrict Program features, or require additional identity or payment verification. Failure to cooperate with a reasonable investigation may result in suspension or termination.
13. Suspension and termination
You may leave the Program by contacting us or using any available account-closure option.
We may suspend or terminate your participation if you breach these Terms or another 99k Africa policy; your main account is banned, suspended, or deactivated; we identify suspected fraud, manipulation, or unlawful activity; your promotion creates material legal, security, or reputational risk; you provide false or misleading information; or we discontinue or materially restructure the Program.
After termination, affiliate links may stop working immediately. Pending and available commissions will be reviewed for eligibility. Valid payable commission remains subject to normal payout requirements, while fraudulent, reversed, or ineligible commission may be withheld or cancelled to the extent permitted by law.
Provisions concerning reversals, negative balances, confidentiality, intellectual property, liability, disputes, and taxes survive termination.
14. Taxes
You are responsible for determining and paying taxes, levies, duties, or other government charges arising from affiliate income. We may request a Tax Identification Number or supporting documentation and may deduct or withhold amounts where required by law. Nothing in these Terms constitutes tax advice.
15. Privacy and data protection
We may process application details, account information, affiliate-link activity, attributed transactions, device or technical identifiers, fraud signals, and payout information to operate and protect the Program. Such processing will be handled in accordance with our Privacy Policy and applicable data-protection law.
You are independently responsible for personal information you collect through your own websites, forms, mailing lists, or promotional activities. You must have a lawful basis for that collection, provide appropriate privacy notices, and maintain reasonable security safeguards.
You may not obtain customer information from 99k Africa for unrelated marketing or sell, disclose, or misuse customer information.
16. Confidentiality
Information identified as confidential, or which should reasonably be understood to be confidential, must not be disclosed or used outside your participation in the Program. This includes non-public commission arrangements, fraud controls, customer information, unreleased products, and internal business information.
17. No earnings guarantee
We do not guarantee that you will generate clicks, orders, commission, or any particular level of income. The Program, affiliate links, and reporting systems may occasionally be unavailable or affected by maintenance, third-party providers, customer privacy settings, or technical failures.
Nothing in these Terms excludes any right or liability that cannot lawfully be excluded.
18. Liability and indemnity
To the extent permitted by law, Care Med LLC and 99k Africa will not be liable for indirect, incidental, special, or consequential loss arising from participation in the Program, including loss of anticipated income, audience, goodwill, or business opportunity.
Subject to liabilities that cannot lawfully be limited, our aggregate liability relating to the Program will not exceed the total valid commission paid or payable to you during the six months preceding the event giving rise to the claim.
You agree to indemnify Care Med LLC and 99k Africa against third-party claims, penalties, losses, or reasonable expenses caused by your unlawful promotions, breach of these Terms, infringement of third-party rights, misuse of personal information, or tax obligations.
19. Changes to the Program and Terms
We may change Program features, attribution periods, commission rates, withdrawal requirements, or these Terms. Material changes will be communicated through the platform, email, or another reasonable method, and we may require acceptance of a new Terms version before continued participation.
Changes to commission rates will ordinarily apply prospectively. Commission already recorded for an eligible order will not normally be recalculated solely because a later rate is introduced. Continuing to participate after updated Terms take effect constitutes acceptance where permitted by law.
20. Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles. Mandatory laws that apply where you or customers are located are not excluded.
Before commencing court proceedings, each party should attempt in good faith to resolve a dispute by written notice and discussion for at least 30 days. If the dispute cannot be resolved, it may be submitted to a court of competent jurisdiction in Texas, United States, unless applicable law requires otherwise.
21. General provisions
These Terms, together with the documents incorporated by reference, constitute the agreement governing your participation in the Program. If any provision is found unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision immediately does not waive the right to enforce it later.
You may not transfer your participation or rights without our written approval. We may transfer our rights and obligations as part of a lawful corporate restructuring, merger, acquisition, or transfer of the Program. Electronic acceptance of these Terms has the same effect as a written signature.
